1.The app
Waiting Games: Solitaire ("the app") is a Klondike solitaire game for iOS and Android that runs entirely on your device. It is provided by Waiting Games, part of OfflineApps ("we", "us"). By downloading or using the app, you agree to these terms.
2.License
When you obtain the app through the Apple App Store or Google Play, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the app on devices you own or control, for your personal, non-commercial use, in accordance with these terms and the applicable store's terms of service.
On iOS, your use of the app is also governed by Apple's standard Licensed Application End User License Agreement. Where that EULA and these terms overlap, the EULA controls for copies obtained through the App Store.
3.One-time purchase
The app is sold as a one-time purchase of $2.99. There is no subscription, no account, and no in-app purchase of any kind. Payments, refunds, and billing are handled by Apple or Google under their own policies, and any refund request is subject to the rules of the store where you bought the app. A purchase on one store does not include the app on the other.
4.Your data
Everything the app saves, your settings, statistics, best times, and the deal in progress, is stored only on your device. Deleting the app deletes the saved game and statistics. We cannot restore them, because we never had them.
5.Acceptable use
You agree not to reverse engineer, decompile, or attempt to extract the source code of the app, except to the extent this restriction is prohibited by law, and not to use the app in any unlawful way.
6.Intellectual property
The app, the Waiting Games name, our marks, and our designs are owned by us and protected by intellectual property law. These terms grant you no rights in our trademarks or branding.
The classic card faces are adapted from public-domain artwork. Open-source components and their licenses are listed in the app under Settings, Licenses.
7.Warranty disclaimer
The app is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the app will be uninterrupted or error-free. Outside the winnable deals option, we do not guarantee that any dealt game can be won, and even with that option on, the solver's promise applies to the deal as dealt, not to any particular sequence of play. A winnable deal can still be lost.
8.Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the app. Where liability cannot be excluded, our total liability is limited to the amount you paid for the app.
9.Changes
We may update these terms from time to time. Changes will be posted on this page with a new effective date. Continued use of the app after a change means you accept the updated terms.
